Section 34 Disposition versions

34. The selection conditions of the Québec graduate component are the following:

(1)  stay in Québec;

(2)  in the 3 years preceding the filing of the application, have obtained from a Québec educational institution a university diploma attesting to a bachelor’s degree, a master’s degree or a doctorate, a diploma of college studies in a technical program, a vocational diploma attesting to at least 1,800 hours or a vocational diploma followed by an attestation of vocational specialization cumulatively attesting to at least 1,800 hours and leading to a specific trade;

(3)  have stayed in Québec for the main purpose of studying and for at least half the duration of his or her program or programs attested to by the diploma and, where applicable, by the attestation referred to in paragraph 2;

(4)  comply with one of the following conditions:

(a)  have completed the program or programs in French;

(b)  have successfully completed at least 3 years of full-time studies in French at the secondary or post-secondary level;

(5)  if applicable, have complied with any condition for the return to the country imposed by a bursary for studying in Québec;

(6)  have a written knowledge of French at level 5 or above according to the Échelle québécoise des niveaux de compétence en français.

34. The Minister selects, under the Québec experience program, a foreign national staying in Québec with the main purpose of working or taking part in a youth exchange program under an international agreement entered into by Québec or Canada, if the foreign national

(1)  has complied with the conditions of the stay;

(2)  does hold full-time employment in Québec, in skill level 0, A or B within the meaning of the National Occupational Classification, and held such employment during a period of at least 24 months in the 36 months preceding the date of filing of the application;

(3)  shows an intermediate oral knowledge of French, level 7 or level 8 according to the Échelle québécoise des niveaux de compétence en français des personnes immigrantes adultes or its equivalent and, as the case may be,

(a)  has filed the result of a standardized test showing the oral knowledge of French;

(b)  has submitted a document certifying that the foreign national has met the requirements relating to the practice of a profession governed by a professional order in accordance with section 35 of the Charter of the French language (chapter C-11); or

(c)  has successfully completed at least 3 years of full-time studies in French at the secondary or post-secondary level; and

(4)  complies with Factor 9, that deals with financial self-sufficiency, of the Selection grid for the economic class in Schedule A;

(5)  if included in the application, the spouse or de facto spouse shows an advanced beginner’s oral knowledge of French, level 4 according to the Échelle québécoise des niveaux de compétence en français des personnes immigrantes adultes or its equivalent and, as the case may be,

(a)  has filed the result of a standardized test showing the oral knowledge of French;

(b)  has filed a document certifying that the foreign national has met the requirements relating to the practice of a profession governed by a professional order in accordance with section 35 of the Charter of the French language (chapter C-11);

(c)  has successfully completed at least 3 years of full-time studies in French at the secondary or post-secondary level.

34. The Minister selects, under the Québec experience program, a foreign national staying in Québec with the main purpose of working or taking part in a youth exchange program under an international agreement entered into by Québec or Canada, if the foreign national

(1)  has complied with the conditions of the stay;

(c)  has successfully completed at least 3 years of full-time studies in French at the secondary or post-secondary level.

34. The Minister selects, under the Québec experience program, a foreign national staying in Québec with the main purpose of working or taking part in a youth exchange program under an international agreement entered into by Québec or Canada, if the foreign national

(1)  has complied with the conditions of the stay;

(2)  does hold full-time employment in Québec and held such employment during a period of at least 12 months in the 24 months preceding the date of filing of the application;

(3)  shows an intermediate oral knowledge of French, level 7 or level 8 according to the Échelle québécoise des niveaux de compétence en français des personnes immigrantes adultes or its equivalent and, as the case may be,

(a)  has filed the result of a standardized test showing the oral knowledge of French;

(b)  has submitted a document certifying that the foreign national has met the requirements relating to the practice of a profession governed by a professional order in accordance with section 35 of the Charter of the French language (chapter C-11); or

(c)  has successfully completed at least 3 years of full-time studies in French at the secondary or post-secondary level or an intermediate French course, level 7 or level 8 according to that scale or its equivalent, offered by a Québec educational institution in Québec; and

(4)  complies with Factor 9, that deals with financial self-sufficiency, of the Selection grid for the economic class in Schedule A.

2019-11-01

34. The Minister selects, under the Québec experience program, a foreign national staying in Québec with the main purpose of working or taking part in a youth exchange program under an international agreement entered into by Québec or Canada, if the foreign national

(1)  has complied with the conditions of the stay;

(2)  does hold full-time employment in Québec included in the list of employment in demand collated by the Minister under section 28 of the Act;

(3)  has held the employment

(a)  for at least 12 months in the 24 months preceding the date of filing of the application in the case of a foreign national who holds an employment in skill level 0, A or B within the meaning of the National Occupational Classification;

(b)  for 18 months in the 24 months preceding the date of filing of the application in the case of a foreign national who holds an employment in skill level C or D within the meaning of the National Occupational Classification;

(4)  has met the conditions for access, as listed in the National Occupational Classification, applicable to the profession the foreign national practises as part of the employment;

(5)  has complied with the special conditions of the employment offer;

(6)  the employment held is not in a field listed in Part 2 of Schedule E;

(7)  the employment held is not on behalf of the foreign national or an enterprise over which the foreign national exercises control;

(8)  the foreign national and, as the case may be, the foreign national’s spouse or de facto spouse show an intermediate oral knowledge of French, level 7 or level 8 according to the Échelle québécoise des niveaux de compétence en français des personnes immigrantes adultes or its equivalent, that they show, as the case may be,

(a)  by the result of a standardized test;

(b)  by the meeting of the requirements relating to the practice of a profession governed by a professional order in accordance with section 35 of the Charter of the French language (chapter C-11); or

(c)  by the successful completion of at least 3 years of full-time studies in French at the secondary or post-secondary level; and

(9)  complies with Factor 9, that deals with financial self-sufficiency, of the Selection grid for the economic class in Schedule A.

2018-08-02

34. The Minister selects, under the Québec experience program, a foreign national staying in Québec with the main purpose of working or taking part in a youth exchange program under an international agreement entered into by Québec or Canada, if the foreign national

(1)  has complied with the conditions of the stay;

(2)  does hold full-time employment in Québec and held such employment during a period of at least 12 months in the 24 months preceding the date of filing of the application;

(3)  shows an intermediate oral knowledge of French, level 7 or level 8 according to the Échelle québécoise des niveaux de compétence en français des personnes immigrantes adultes or its equivalent and, as the case may be,

(a)  has completed the program of studies in Québec entirely in French;

(b)  has filed the result of a standardized test showing the oral knowledge of French;

(c)  has submitted a document certifying that the foreign national has met the requirements relating to the practice of a profession governed by a professional order in accordance with section 35 of the Charter of the French language (chapter C-11); or

(d)  has successfully completed at least 3 years of full-time studies in French at the secondary or post-secondary level or an intermediate French course, level 7 or level 8 according to that scale or its equivalent, offered by a Québec educational institution in Québec; and

(4)  complies with Factor 9, that deals with financial self-sufficiency, of the Selection grid for the economic class in Schedule A.

34. The Minister selects, under the Québec experience program, a foreign national staying in Québec with the main purpose of working or taking part in a youth exchange program under an international agreement entered into by Québec or Canada, if the foreign national

(1)  has complied with the conditions of the stay;

(2)  does hold full-time employment in Québec and held such employment during a period of at least 12 months in the 24 months preceding the date of filing of the application;

(3)  shows an intermediate oral knowledge of French, level 7 or level 8 according to the Échelle québécoise des niveaux de compétence en français des personnes immigrantes adultes or its equivalent and, as the case may be,

(a)  has completed the program of studies in Québec entirely in French;

(b)  has filed the result of a standardized test showing the oral knowledge of French;

(c)  has submitted a document certifying that the foreign national has met the requirements relating to the practice of a profession governed by a professional order in accordance with section 35 of the Charter of the French language (chapter C-11); or

(d)  has successfully completed at least 3 years of full-time studies in French at the secondary or post-secondary level or an intermediate French course, level 7 or level 8 according to that scale or its equivalent, offered by a Québec educational institution in Québec; and

(4)  complies with Factor 9, that deals with financial self-sufficiency, of the Selection grid for the economic class in Schedule A.
